In accordance with the application of the law of Democratic Memory Law 20/2022 dated 19 October, there are two cases that while appearing to fall under this legislation, they must actually be processed as Recovery of Nationality.

Consequently, these cases are not restricted by the same deadline, which concludes on 22 October 2025.

The specific cases are:

– SPANISH CITIZENS WHO MARRIED BEFORE 2 MAY 1975 AND ACQUIRED THE NATIONALITY OF THEIR HUSBANDS.

– THOSE PERSONS BORN OUTSIDE OF SPAIN, OVER 21 YEARS OF AGE, WHEN ONE OF THEIR PARENTS WAS SPANISH AT THE TIME OF THEIR BIRTH.

How is nationality recovered?

A person who has lost their Spanish citizenship can recover it if they fulfil these conditions:

  • Complete and sign the necessary documentation and the corresponding forms for this purpose.
  • Complete the procedures in person at the Civil Registry Office closest to the individual’s place of residence. For residents outside of Spain, the application for the recovery of Spanish citizenship must be submitted at the Consular Office.

– The presence of the interested party is necessary throughout the procedure.
