High Court hears dispute over Ragley Estate trusts

A High Court legal battle is currently under way involving William Seymour, Earl of Yarmouth, and his parents, the Marquess and Marchioness of Hertford, over the family trusts controlling the £85 million Ragley Estate in Warwickshire. The case centres on the Earl’s request to restructure the trusts, citing alleged bias from the current trustees.

Background to the case

Relations between Earl Yarmouth and his parents deteriorated significantly following the Earl’s marriage in 2018. Subsequently, the Earl’s expectation that he would control of Ragley Hall, the family’s ancestral estate, upon turning 30 was not met.

The Earl has expressed feelings of “trauma” resulting from these unmet expectations and sought professional counselling to help him cope. He alleges in his claim at court that the trustees of controlling the family estate unduly favour his parents and that, in consequence, they should be removed from their trusteeship.

Lord and Lady Hertford have challenged these claims, suggesting their son acted “unreasonably” in raising the matter of succession and that his behaviour has created tension within the family. They, along with the trustees and the Earl’s three siblings, oppose any restructuring of the trusts.

Court proceedings

The case was recently heard in the High Court by Master Brightwell. The Earl of Yarmouth’s barrister highlighted the breakdown in the relationship between the Earl and the trustees. Meanwhile, the legal representatives for the trustees and the Earl’s parents denied allegations of bias and defended the current arrangements, citing concerns over the potential impact on the estate’s management.
