What is a Digital Nomad Visa ?

The Spanish Digital Nomad Visa, is a new visa that was entered into force to promote the start-up ecosystem in Spain, which has been a game-changer for individuals seeking a flexible and remote-friendly lifestyle. This innovative visa opens up exciting opportunities for digital nomads, freelancers, and remote workers who wish to live and work in Spain.

A new law has entered into force Law 28/2022 on promoting the start-up ecosystem. Now, Non-EU citizens (from outside the European Union) who wish to move to Spain and continue working for a company abroad, or who have clients spread all over the world, will find a residence permit that perfectly suits their needs.

One key aspect of the Spanish Nomad Visa is its duration—valid for up to 3 years, with the option to renew. This offers a level of stability that is often lacking in other short-term visa options, providing nomads with the chance to truly immerse themselves in the rich culture and diverse landscapes of Spain.

The digital nomad visa is a residence permit that can be extended for a total of 5 years and will allow non-EU citizens to live and work remotely from Spain.

Who can apply?

Applicants must hold an undergraduate or postgraduate degree from a University, College or Business School alternatively they can have a minimum of 3 years work experience in their current industry as well as one of the following conditions:

1.- Employees whose company allows them to travel and work remotely from another country (in this case Spain).

2.- Self-employed workers with several clients spread all over the world or sources of income derived from online activities but spread outside Spain. You can have clients within Spain, but these must not exceed 20% of your revenue.

How to apply?

There are two ways:

1.- You can apply directly from Spain with a tourist visa, if required, within 90 days of entry into Spain. Obtaining the 3-year card directly. It can be renewed for up to 5 years.

2.- You can apply at the Spanish Consulates in the United Kingdom and around the world, obtaining a 1 year visa. It can be renewed for up to 3 and 5 years.

What Do You Need to Apply for the Digital Nomad Visa?

You’ll need the following to apply for the Digital Nomad Visa in Spain:

  • Original & copies of your passport as well as anyone who is applying with you.
  • Copy of your employment contract or proof of previous agreements if self-employed as well as future contracts.
  • Authorisation from your employer that you are allowed to work remotely from Spain.
  • Proof the company you work for has been in business for more than a year.
  • Minimum 3 years work experience within your current field of work or an undergraduate/postgraduate certificate from a renowned University, College or Technical School.
  • Private Health Insurance for Spain.
  • Evidence your work can be completed remotely.

You may be asked for additional information or certificates such as a criminal record or medical certificate as well as proof of adequate income to support any family members you wish to take with you.

Advantages of the Digital Nomad Visa

1.- This permit will allow to the spouse and children join in the same application, allowing the whole family to move to Spain.

2.- As it is framed within the Entrepreneurs Law, there is also the benefit of an express resolution in just 20 days.

3.- In addition, freedom of movement throughout the EU with this residence card.

4.- One of the main attractions of this new permit comes from the fiscal side. The additional argument created to make this permit an even better option is the special tax regime that will allow digital nomad visa holders to save taxes. Basically, they will be taxed through an optimised non-resident income tax regime.

5.- After 5 years of working within Spain as a digital nomad you’ll be eligible to apply for a permanent residency visa.

Can I work in Spain with the digital nomad visa?

Yes, as mentioned above, the residence for digital nomads allows non-EU citizens to work remotely from Spain.

While this means working in Spain for a foreign company, is it possible to work in Spain for a Spanish company or client with this permit?

The answer is yes, but with an important limit.

You can also work for a Spanish company if a) you maintain the commercial/contractual relationship with the foreign company that allowed you to obtain this visa; and b) the income you generate from the Spanish company or client does not account for more than 20% of your total income.
