Starting on 1 October 2022, remote right – to – work checks will no longer be sufficient to satisfy Home Office requirements. As of this date, there are three ways for an employer to conduct valid right to work checks:

  1. Online Right to Work Check: This service is available to those holding a current Biometric Residence Permit (BRP), Biometric Residence Card (BRC), Frontier Worker Permit (FWP) or an eVisa to view their right to work status and share this with an employer via a share code.
  2. Manual Check: This is only applicable to British and Irish nationals, as well those who hold other types of time limited permission. The original documents of these individuals must be checked manually, face to face with the candidate.
  3. Using the services of an identity service provider (IDSP): This is an alternative method to manual checks for conducting checks on British and Irish citizens with a valid passport and is not free of charge.

It is important to note that employers should conduct right to work checks on new employees before their employment starts. They must also carry out follow – up checks on employees on time – bound visas.
