COVID-19 update: possession notices and gas safety checks

The Coronavirus Bill has now received Royal Assent. Landlords with assured, assured shorthold, secure, introductory and flexible tenancies will need to serve three months’ notice when seeking possession on any grounds (including ASB). This requirement is likely to remain in place until at least 30 September 2020.

Landlords using assured shorthold tenancies should note that three months’ notice is also required when serving notice under s21 of the Housing Act 1988.

Landlords intending to serve notice during the next six months will need to amend their precedent notices accordingly.

Some landlords have expressed concern in relation to obtaining access for gas safety checks. In the event that access is not permitted because the tenant is self-isolating, careful notes should be made in order to show that the landlord used best endeavours to have the gas inspection undertaken.
