We are pleased to share the news of two recent matters in which our Planning team helped achieve successful outcomes for clients:

Stopping up and Diversion Order granted to Folkstone and Hythe District Council – Jan 2022

We advised Folkstone and Hythe District Council in their stopping up and diversion order at Princes Parade, Folkstone and are pleased that the order had been made by the Secretary of State for Transport despite objections, as the Secretary of State was satisfied that the advantages of stopping up the area and delivering the route would be outweighed by the disadvantages put forward by the objectors.

We are pleased that the Secretary of State agreed with the Council that the order would bring many benefits which included safer and more varied car parking opportunities, improved car parking for the disabled, improved cycle routes and improved highway safety. A partial award of costs was also made against the main objectors for raising and continuing to present evidence on irrelevant matters and wasting the inquiry time and evidence.

Enforcement – Successful costs award

We advised landowner on receipt of an Enforcement Notice for change of use of the land to mixed use of agriculture and the stationing and residential occupation of caravans in Cambridgeshire. We advised on the appeal against the Enforcement Notice, leading to the withdrawal of the notice by the Council and full award of costs to our client.
