Wills

Comprehensive Will for married person or civil partner £125

This Will is suitable for anyone who is married or in a civil partnership. It will allow you to make as many gifts of money or specific items as you like. You will be able to leave the remainder of your estate after making gifts (i.e. the residuary estate) to as many persons you would like, either in equal shares or in varying percentages. You can also vary how you would like to leave your residuary estate, make provisions for the care of pets and appoint guardians for your children. (Those with spouses/civil partners domiciled outside the UK should note that the normal tax-free allowances do not apply, and we recommend tax advice is sought in these cases). This Will is suitable for use in England and Wales and Northern Ireland.

Notice of severance of a joint tenancy £65

This document is used to create all three documents needed to sever a joint tenancy, that is to say, to convert it into tenants in common where joint tenants each own a given proportion of the property. The documents produced are Land Registry Form SEV, Notice of Severance and Letter to Land Registry. Please note that this document can only be used in England & Wales.

   

 

Powers of attorney

General power of attorney (England & Wales) £100

Granting a general power of attorney allows someone else (the appointed attorney) the authority to manage your (the donor's) affairs for a set period of time, for example, whilst overseas for a couple of years. This particular general power of attorney is suitable for use in England & Wales only.  As a general power of attorney becomes invalid if you become mentally incapable, it is not suitable for managing the affairs of ailing relatives, unless they are of sound mind, and a lasting power of attorney should be used instead.

   

Lasting power of attorney - Property and financial affairs £375

If some day you are no longer able to look after your own financial affairs, due to such factors as an illness, accident or the onset of dementia, or if for another reason it would be more convenient for someone else to do so, you can use this document to give that power to another person, called your "attorney". Once the power comes into effect, your attorney (or attorneys) will have the legal authority to act on your behalf in financial matters. Your attorney(s) will be able to use the document to act on your behalf as soon as it is registered, unless you specify otherwise in your LPA. Please note that this document can only be used in England & Wales.

      

Lasting power of attorney- Health and welfare £375

If some day you are no longer able to look after your own personal welfare, that is your social and health care needs, this document will give that power to another person, called your "attorney". Once the power comes into effect, your attorney (or attorneys) will have the legal authority to act on your behalf in matters relating to your personal welfare, subject to any restrictions you make. Your attorney(s) will only be able to act when you lack the capacity to do so yourself, for example, if you are ill, unconscious or because of the onset of a condition such as dementia. Please note that this document can only be used in England & Wales.

   

 

Powers of attorney - registration

EP1 PG - Notice of intention to register an EPA (England & Wales) £75

If you are the attorney in an EPA and wish to register the document, you must give notice of your intention to register with EP1 PG. You must notify the donor and a minimum of three of the donor's relatives in the order presecribed by the Mental Capacity Act (which is explained in the document notes). This document is only suitable if one or two attorneys are registering the document. This document should only be used for EPAs which are valid in England & Wales.

   

EP2 PG - Application to register an EPA (England & Wales) £75

Use this document if you were appointed an attorney under an enduring power of attorney (EPA) in England & Wales and you need to register the EPA because the donor is, or is becoming, incapable of managing his or her own affairs. You must make this application to register the EPA within 10 working days of serving the last EP1 PG notice, notifying the donor's relatives of your intention to register. If you have not yet served the EP1 PG notice, you should do so now. Please note that you can no longer create EPAs in England & Wales; however, you can continue to register an EPA as long as it was signed before 1 October 2007.

   

LPA 1 - Notice of intention to register an LPA £75

Before registering a lasting power of attorney (LPA), whether property and affairs or personal welfare, use this document to notify any 'named person(s)' in the LPA of your intention to register. All persons named in the LPA must be notified before an LPA can legally come into effect. The named persons will then have five weeks from the date of this notice to object to the registration.

Since the LPA allows for up to 5 named persons, this document will create 5 copies (4 pages each) of the notice of intention.

Please note that as the lasting power of attorney is only valid in England & Wales, this document can only be used in that jurisdiction.

   

LPA 2 - Application to register a lasting power of attorney £75

If you are an attorney in a lasting power of attorney (LPA) or the donor, you can use this document to register the LPA with the Office of the Public Guardian. There will be a fee payable to register the document and you should check with the Public Guardian to find the current fee. If the donor has made both a property and affairs LPA and a personal welfare LPA, you will have to register these documents separately. As this form will be scanned by the Public Guardian, our font has been designed to accommodate this scanning process. Please note that you cannot use this document if there are more than four attorneys registering the LPA jointly.
